Do I have to empty my home completely before selling it?

The sale of a property can raise many questions. One that sellers frequently ask is: “Do I have to empty my property and clean it before handing over the keys?” BIV Immobilier, your estate agency in Liège, answers it in this article!

Emptying a home for sale: your obligations in Belgium

In Belgium, the law does not require a seller to empty their property completely and clean it once it has been sold. However, the sales agreement (compromis) may contain specific clauses regarding the condition
of the property
when the keys are handed over and the seller’s responsibilities.

  • If the sales agreement stipulates that the property must be handed over empty: the seller is obliged to make sure that all furniture, personal
    belongings and other items are removed.
  • If the sales agreement says nothing on the matter: in this case, the buyer generally agrees to take the property as it stands, which may include furniture or other personal effects.

What should I do if I can’t empty my home in time?

If you are unable to empty your home before the deed is signed and the keys are handed over, even though this was provided for in the sales agreement, let your estate agent know. Depending on your situation, they can advise you on one of the following solutions:

  • Negotiate extra time with the buyer so you can empty the home;
  • Agree to pay compensation to the buyer for the inconvenience caused;
  • Call in a house clearance company, which will clear all the spaces, inside and out.
